Terms and Conditions
1. Introduction
These Terms and Conditions govern the use of the
TUMCOS Mobile Banking application and
TUMCOS GoDown 360° e-Services application
and related digital services provided by
Tota Utpannagala Marata Sahakara Sangha Niyamitha
(TUMCOS ).
By downloading, installing, registering for, accessing or
using any of these applications or services, the Customer
acknowledges that he/she has read, understood and agreed
to be bound by these Terms and Conditions.
If the Customer does not agree with any part of these
Terms and Conditions, the Customer should not register
for or use the respective service.
2. Digital Services Covered
TUMCOS Mobile Banking
TUMCOS Mobile Banking is a digital Banking/service
platform that enables eligible customers or members
to access permitted account and service-related
facilities through a registered mobile device.
The services available through the application may
include account-related information, transaction
facilities, notifications, statements and other
digital services introduced by TUMCOS from time to
time.
TUMCOS GoDown 360° e-Services
TUMCOS GoDown 360° e-Services is a digital platform
designed to provide eligible members and customers
with convenient access to TUMCOS godown and
commodity-related services.
Depending upon the services enabled for the
Customer, the application may provide access to
godown information, commodity details, stock
information, receipts, transactions, status,
notifications and other related services.
3. Acceptance of Terms
Registration, activation, access or continued use of
TUMCOS Mobile Banking or TUMCOS GoDown 360° e-Services
shall constitute acceptance of these Terms and
Conditions.
TUMCOS reserves the right to modify, amend, add or
remove any provision of these Terms and Conditions from
time to time.
Such changes may be communicated through the application,
official website, branch notices, SMS, email or any
other appropriate communication channel.
4. Eligibility
Access to the Services shall be available only to
eligible members, customers or users as determined by
TUMCOS and subject to applicable rules and requirements.
TUMCOS may restrict or deny access where the Customer
does not satisfy the eligibility criteria or where
required information or verification has not been
completed.
5. Registration and Activation
Depending upon the service, registration may require
the Customer to:

Download the official TUMCOS application.

Enter the registered mobile number.

Complete OTP or other authentication procedures.
-
Provide required customer or member information.
-
Create or activate a password, MPIN or other
authentication credential.
6. Security of Credentials
The Customer is responsible for maintaining the
confidentiality of passwords, MPINs, OTPs, PINs and
other authentication credentials.
Important Security Notice:
Customers must never share their OTP, MPIN, password,
PIN or other security credentials with any person.
TUMCOS will not normally request such confidential
information through telephone calls, SMS, email or
social media.
7. Customer Responsibilities
The Customer agrees to:

Provide accurate and complete information.

Keep registered mobile number and contact details
updated.

Keep login credentials confidential.
-
Protect the mobile device used to access the Services.
-
Immediately report loss or theft of the mobile
device or SIM card.
-
Immediately report suspected unauthorized access
or transactions.
-
Use only the official TUMCOS application.
-
Not permit another person to use the Customer's
credentials.
8. Transactions and Instructions
TUMCOS may act upon instructions received through the
Services after successful authentication of the Customer,
subject to applicable limits, controls and procedures.
Customers should carefully verify all transaction details
before confirming any transaction or request.
A transaction or instruction once submitted may not be
cancelled or reversed unless permitted by TUMCOS and
applicable rules.
9. TUMCOS GoDown 360° e-Services
TUMCOS GoDown 360° e-Services may provide digital access
to information and services relating to TUMCOS godown
operations.
Depending upon the services enabled for the Customer,
the platform may provide:
- Godown / warehouse information.
- Commodity information.
- Stock information.
- Receipt information.
- Deposit and withdrawal information.
- Transaction history.
- Status information.
- Notifications and alerts.
- Other services introduced by TUMCOS .
10. Digital Records
Information displayed through TUMCOS GoDown 360°
e-Services is provided for operational and informational
purposes.
In case of any discrepancy between information displayed
through the application and official records maintained
by TUMCOS , the official records maintained by TUMCOS
shall be considered for verification, subject to
applicable law and procedures.
11. Availability of Services
TUMCOS will make reasonable efforts to keep the Services
available. However, uninterrupted or error-free
availability cannot be guaranteed.
Services may be temporarily unavailable due to
maintenance, system upgrades, internet connectivity
problems, power failure, server issues, technical
problems, security incidents or circumstances beyond
the reasonable control of TUMCOS .
12. Mobile Device and SIM Card
The Customer is responsible for the security of the
mobile device and SIM card used to access the Services.
In case of loss or theft, the Customer must immediately
contact the mobile network operator and inform TUMCOS
through an official communication channel.
13. Privacy and Customer Information
It’s easy to get started with Mobile Banking.
- Download the app and accept the terms and condition
- Enter your mobile phone number to receive a one-time activation code by text message
- Enter the activation code in the app
- Create a Mobile Banking passcode, between 4 digits
- You’ll now have access to your accounts via the mobile app
Responsibilities and obligations of the Customer.
- The Mobile Banking App is provided "as is" with no representation, guarantee or agreement of any kind as to its functionality. We cannot guarantee that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your mobile device. We are not responsible for any loss you may incur as a result of this.
- We are responsible for the Mobile Banking App and its content. Apple Inc., Google Inc., Microsoft Corporation or Research in Motion Limited do not have any responsibilities or obligations to you in relation to the Mobile Banking App and will not provide any maintenance and support services for the Mobile Banking App
- While we make reasonable efforts to provide the Mobile Banking App services, we will not be liable for any failure to provide those services, in part or in full, due to abnormal and unforeseen circumstances beyond our control, the consequences of which would have been unavoidable despite all efforts to the contrary. This includes any phone network failures or, in the case of mobile networks, where you are not in an area of mobile coverage.
- The Customer shall keep the Password confidential and will not disclose these to any other person or will not record them in a way that would compromise the confidentiality of the same or the security of the service.
- The Customer will use the services offered under Mobile Banking using the Password in accordance with the procedure as laid down by the Society from time to time, including the terms and conditions contained herein.
- The Customer shall take all possible steps to ensure that the Application, all passwords and his/her mobile phone are not shared with anyone and shall take immediate action to de-register from Mobile Banking service as per procedure laid down in case of misuse/ theft/loss of the mobile phone or SIM card.
- The Customer will be responsible for all transactions, including unauthorized /erroneous/ wrong/ incorrect/mistaken/false transactions made through the use of his/ her mobile phone, SIM card, Password, regardless of whether such transactions are in fact entered into or authorized by him/ her. The Customer will be responsible for the loss/damage, if any suffered in respect of all such transactions done through his/her phone or any other phone.
- It will be the responsibility of the Customer to notify the TUMCOS immediately if he/ she suspect the misuse of the Password. He will also immediately initiate the necessary steps to change his Password.
- If the mobile phone or SIM is lost, the user must immediately take action to suspend from Mobile Banking at any TUMCOS branch/Home branch.
- The Customer accepts that any valid transaction originating from the Password and / or registered mobile phone number shall be assumed to have been initiated by the Customer and any transaction authorized by the OTP is duly and legally authorized by the Customer.
- The Customer shall keep himself/herself updated with regard to any information/ modification relating to the services offered under the Service which would be publicized on the TUMCOS website and at the branches and would be responsible for taking note of / compliance of such information/ modifications in making use of the Service.
- The Customer shall be liable for all loss or breach of the Terms and Conditions contained herein or contributed or caused the loss by negligent actions or a failure to advise the TUMCOS within a reasonable time about any unauthorized access in the account.
- The Customer shall be liable and responsible for all legal compliance and adherence of all commercial terms and conditions in respect of the mobile connection/SIM card/mobile phone through which the service is availed and the Society does not accept/ acknowledge any responsibility in this regard. It is the responsibility of the Customer to notify the TUMCOS , about any change in mode of operation, through a separate communication, making a specific reference to the Mobile Banking availed. It is also the responsibility of the Customer to notify the Society, any other change in the operation of the account which will otherwise make the account ineligible for the Mobile Banking. Any failure on the part of the Customer to advise the Society separately shall continue to bind all the account holders, jointly and severally for the transactions through this Service.
- The TUMCOS is unable to receive or execute any of the requests from the Customer or there is loss of information during processing or transmission or any unauthorized access by any other person or breach of confidentiality or due to reasons beyond the control of the OFFICE.
- There is any kind of loss, direct or indirect, incurred by the Customer or any other person due to any failure or lapse in the MB Service which are beyond the control of the TUMCOS .
- There is any failure or delay in transmitting of information or there is any error or inaccuracy of information or any other consequence arising from any cause beyond the control of the TUMCOS which may include technology failure, mechanical breakdown, power disruption, etc.
- There is any lapse or failure on the part of the service providers or any third party affecting the said Service and that the TUMCOS makes no warranty as to the quality of the service provided by any such provider.
- The TUMCOS , its employees, shall not be liable for and in respect of any loss or damage whether direct, indirect or consequential, including but not limited to loss of revenue, profit, business, contracts, anticipated savings or goodwill, loss of use or value of any equipment including software, whether foreseeable or not, suffered by the Customer or any person howsoever arising from or relating to any delay, interruption, suspension, resolution or error of the TUMCOS in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or message to and from the telecommunication equipment of the Customer and the network of any service provider and the Society 's system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the Customer, the Society 's system or the network of any service provider and/or any third party who provides such services as is necessary to provide the Service.
- The TUMCOS will not be responsible if the Application is not compatible with/ does not work on the mobile handset of the Customer.
- In consideration of TUMCOS agreeing to provide to the Customer the Mobile Banking Service, the Customer hereby irrevocably agrees, to indemnify and keep TUMCOS indemnified, at all times hereafter, from all losses, damages, costs, legal fees, charges and expenses and consequences whatsoever, suffered or incurred by TUMCOS on account of any claims, actions, suits or otherwise instituted by the Customer, or any third party whatsoever, arising out of or in connection with the use of the Mobile Banking Service and any and all transactions initiated by the use of the Mobile Banking Service, whether with or without the knowledge of the Customer, or whether the same have been initiated bona fide or otherwise which transactions, the Customer hereby acknowledges, TUMCOS has processed on the Instructions and authority of the Customer in accordance with these Terms & Conditions and other applicable Specific Terms & Conditions, as the case may be. The Customer further agrees and confirms that this indemnity shall remain valid and subsisting and binding upon the Customer notwithstanding withdrawal, either partially or in totality, of the Mobile Banking Service.
Confidentiality and Disclosure.
To the extent not prohibited by applicable law, the TUMCOS Ltd shall be entitled to transfer any information relating to the Customer and/or any other information given by the Customer for utilization of the Payment Platform/Mobile Bankinging Service to and between its branches, subsidiaries, representative offices, affiliates, representatives, auditors and agents of TUMCOS Ltd, Intermediaries and third parties selected by Citizens TUMCOS Ltd, wherever situated, for confidential use in and in connection with the Payment Platform/Mobile Bankinging Service. Notwithstanding anything contained above, TUMCOS Ltd shall be entitled at any time to disclose any and all information concerning the Customer within the knowledge and possession of TUMCOS Ltd (a) to any party in connection with the Payment Platform/Mobile Bankinging Service provided by TUMCOS Ltd and/or its Intermediaries to the Customer, including inter alia, information relating to the cause for termination of Payment Platform/Mobile Bankinging Service (b) to any other bank/association/financial institution or any other body in respect of any negative information in respect of the Customer. This clause will survive the termination of this Agreement. The Customer hereby waives the right of privilege and privacy.
14. Prohibited Activities
Customers shall not:

Attempt unauthorized access to TUMCOS systems.

Modify, reverse engineer or tamper with the
application.

Attempt to bypass security controls.
-
Introduce malware or harmful software.
-
Use another person's credentials.
-
Conduct fraudulent or unauthorized transactions.
-
Use the Services for unlawful purposes.
15. Intellectual Property
The application, software, design, logos, trademarks,
graphics, content and related intellectual property
associated with the Services are owned by or licensed
to TUMCOS or the respective rights holders.
No ownership rights are transferred to the Customer by
using the Services.
16. Suspension or Termination
TUMCOS may suspend or restrict access to the Services
where reasonably necessary, including in cases of
suspected fraud, security concerns, violation of these
Terms and Conditions, regulatory requirements or
technical maintenance.
The Customer may request discontinuation of the Service
through the procedure prescribed by TUMCOS .
17. Limitation of Liability
To the extent permitted by applicable law, TUMCOS shall
not be responsible for losses caused by circumstances
beyond its reasonable control, including internet
failures, telecommunications failures, device failure,
third-party service failure, power interruption,
maintenance, natural disasters or other force majeure
events.
18. Electronic Records
Electronic records maintained by TUMCOS relating to
transactions and service requests may be used as
evidence of the relevant transaction or instruction,
subject to applicable law.
19. Changes to the Terms
TUMCOS may modify these Terms and Conditions from time
to time. Updated Terms and Conditions may be published
through the official TUMCOS website, applications or
other official communication channels.
Continued use of the Services after publication of
revised Terms and Conditions shall constitute acceptance
of the revised Terms.
20. Governing Law
These Terms and Conditions shall be governed by the
applicable laws of India.
Any dispute relating to the Services shall be subject
to the jurisdiction of the competent courts having
jurisdiction over the registered office of TUMCOS ,
subject to applicable law.
21. Customer Support and Grievance Redressal
Customers may contact TUMCOS through its official
branches, office, telephone number, email address or
other official communication channels for assistance,
complaints or service-related issues.
Customers should report unauthorized transactions,
suspicious activity or security incidents immediately.

23. Customer Declaration
By registering, activating or using
TUMCOS Mobile Banking or
TUMCOS GoDown 360° e-Services,
the Customer confirms that:

I have read and understood these Terms and
Conditions.

I agree to comply with these Terms and Conditions.
-
I will keep my password, MPIN, OTP and other
security credentials confidential.

I will immediately report any unauthorized
activity to TUMCOS .
-
I will provide accurate and updated information
whenever required.
